Please read these Terms carefully before using SixPeak. By downloading, installing, or using the SixPeak application, you agree to be bound by these Terms. If you do not agree, do not use the App.
SixPeak is a paid application, offered on an auto-renewing subscription basis. See Section 7.
SixPeak is not a medical device and its AI-generated fitness and nutrition guidance is not professional medical, dietary, or training advice. See Section 9.
These Terms and Conditions ("Terms") form a binding agreement between you ("you", "your", or "User") and NexAtlas Labs ("we", "us", "our"), the developer and operator of the SixPeak mobile application (the "App" or "Service").
By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.
These Terms apply in addition to, and do not replace, the terms of the platform from which you obtained the App (the Apple App Store or Google Play Store). Where a platform's terms conflict with these Terms in respect of billing or distribution, the platform's terms govern that subject.
You must be at least 13 years of age to use the App. If you are between 13 and the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
The App is not directed at children under 13, and we do not knowingly permit their use of the Service. If we become aware that a user under 13 has used the App, we will take reasonable steps to terminate that use.
By using the App you represent that you have the legal capacity to enter into these Terms and are not barred from doing so under any applicable law.
Subject to your compliance with these Terms and payment of any applicable subscription fee, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the App on a device that you own or control, solely for your own personal, non-commercial use.
This licence does not transfer ownership of any part of the App to you. All rights not expressly granted in these Terms are reserved by us.
You may not: copy, modify, adapt, translate, reverse engineer, decompile, or disassemble the App except to the extent that such restriction is prohibited by applicable law; rent, lease, lend, sell, redistribute, or sublicense the App; remove or alter any proprietary notices; or use the App to build a competing product or service.
SixPeak is a fitness application. Its core features are: AI-scored physique photo scans that track your progress over time; an AI coach you can chat with for guidance, which can propose nutrition log entries and profile updates for you to review and confirm; nutrition and workout logging; and real-time exercise form tracking using your device's camera and on-device pose detection.
Physique scans and coach chat replies are generated using artificial intelligence, as described in Section 6. Exercise form tracking is performed entirely on your device and requires no internet connection.
SixPeak is a paid application. Continued access to its features requires an active, auto-renewing paid subscription, as set out in Section 7. We are currently releasing the first update of the App, and we may add, modify, or remove features over time in accordance with Section 14.
The App requests the following device permissions. You may decline or later revoke any of them through your device settings, but doing so will limit or disable the corresponding functionality.

Physique scans and AI coach replies are generated using OpenAI's models, accessed through our backend. When you run a scan or send a message, the photo or message is transmitted to our backend, which forwards it to OpenAI for the sole purpose of producing your result. A response is returned to your device and, in the case of scans and confirmed nutrition entries, saved to your local history.
We do not retain your photographs or chat messages on our backend. They are processed to produce a result and are not written to a database or disk we control. Full details are set out in our Privacy Policy.
AI analysis is probabilistic and may be inaccurate. A physique score, coach reply, or suggested nutrition entry may occasionally be wrong, incomplete, or nonsensical. We do not warrant the accuracy of any AI-generated result. You are responsible for reviewing any suggestion — including a proposed nutrition entry — before you rely on it or confirm it into your log.
AI-verified features require an active internet connection. If your device is offline, the App will inform you that a scan or chat message cannot be processed; on-device features such as exercise form tracking remain unaffected.
We may offer a free trial period for a subscription. Unless you cancel at least 24 hours before the trial ends, the subscription will automatically convert to a paid, auto-renewing subscription and the applicable fee will be charged to your account. Any unused portion of a free trial is forfeited when you purchase a subscription.
SixPeak's features are offered on an auto-renewing subscription basis. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
Your subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
Subscription durations and prices are displayed in the App before you complete a purchase, in your local currency where supported. Prices may vary by region and are subject to change; any price change will not affect your current billing period and will be notified to you in advance as required by the applicable app store.
You are responsible for any taxes, levies, or duties imposed by taxing authorities in connection with your subscription, except where we are required to collect them on your behalf.
Subscriptions are managed through your app store account, not through us. You can view and cancel your subscription at any time:
Deleting the App does not cancel your subscription. You must cancel through your app store account.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you retain access to paid features until that date. We do not provide partial refunds for unused portions of a billing period except where required by law.
All purchases are processed by Apple or Google, not by us. Refund requests must therefore be made to the relevant store, and are granted at that store's discretion under its own policies:
Nothing in this section limits any statutory right of withdrawal or refund available to you under the consumer protection laws of your country of residence. Consumers in the European Union, United Kingdom, and certain other jurisdictions may have a statutory cooling-off period; where such a right applies, it prevails over this section.
Consult a physician before beginning any exercise, diet, or nutrition program, especially if you have any pre-existing medical condition. Stop immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other warning sign while exercising.
SixPeak, its physique scores, coach chat guidance, workout routines, and nutrition suggestions are provided for general informational and motivational purposes only. They are not medical advice, a medical device, or a substitute for consultation with a qualified physician, registered dietitian, or certified trainer. The App does not diagnose, treat, cure, or prevent any disease or condition.
Physical exercise carries an inherent risk of injury. You assume full responsibility for any risk of injury or harm arising from your use of the App, including from following any AI-generated workout routine, exercise-form feedback, or nutrition suggestion. Use common sense, listen to your body, and use the emergency stop or exit controls in the App if a live exercise session becomes unsafe.
Physique scan results and any associated score are AI-generated estimates based on a photo and are not a clinical or diagnostic assessment of your health or body composition.
You agree not to:
We may suspend or terminate your access to the App for any breach of this section, in accordance with Section 15.
The App and all of its contents — including its source code, design, user interface, graphics, illustrations, icons, sounds, text, and the SixPeak name and logo — are owned by NexAtlas Labs or its licensors and are protected by copyright, trade mark, and other intellectual property laws.
Nothing in these Terms grants you any right to use our trade marks, logos, or brand features without our prior written consent.
Third-party components incorporated into the App remain the property of their respective owners and are used under licence.
"Your Content" means any physique photograph, chat message, or other material you create or supply while using the App.
You retain full ownership of Your Content. We do not claim any ownership interest in it, and our backend does not store or retain it after analysis.
You grant us and our AI service provider a limited, temporary licence to process Your Content solely for the purpose of generating a physique score, coach reply, or related suggestion at the moment you submit it. This licence exists only for the duration of that processing and for no other purpose.
You represent and warrant that you have all necessary rights to Your Content, and that submitting it does not infringe the rights of any third party. Please avoid capturing other people, sensitive documents, or private surroundings in a physique photo.
The App relies on the following third-party services, each governed by its own terms and privacy policy:
We are not responsible for the practices, availability, or content of third-party services. Your use of them is subject to their own terms.
We aim to keep the App available and functional, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance, updates, or due to factors outside our control, including outages of our backend or of OpenAI.
We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without notice. Where a change materially reduces the functionality of a paid subscription, we will provide reasonable advance notice and, where required by law, an appropriate remedy.
We may require you to install updates. Some versions of the App may stop working if not updated.
You may terminate these Terms at any time by cancelling any subscription and deleting the App from your devices.
We may suspend or terminate your access to the App immediately, without notice, if you materially breach these Terms, if we are required to do so by law, or if we discontinue the Service.
On termination, the licence granted in Section 3 ends immediately. Sections 11, 12, 16, 17, 18, and 19 survive termination.
To the fullest extent permitted by applicable law, the App is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory. We expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the App will meet your requirements, that AI analysis will be accurate, that any fitness or nutrition outcome will be achieved, or that the App will be uninterrupted, timely, secure, or error-free.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
To the fullest extent permitted by applicable law, NexAtlas Labs and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of or inability to use the App.
This includes, without limitation, any injury, loss, or damage arising from exercise performed while using the App, from reliance on an AI-generated physique score, workout routine, form feedback, or nutrition suggestion, or from any resulting health, financial, or personal consequence.
Our total aggregate liability arising out of or relating to these Terms or the App shall not exceed the greater of (a) the total amount you paid us for the App in the twelve months preceding the claim, or (b) ten United States dollars (US$10).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
You agree to indemnify and hold harmless NexAtlas Labs and its officers, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the App, your violation of any law, or your infringement of any third-party right.
These Terms are governed by the laws of the jurisdiction in which NexAtlas Labs is established, without regard to its conflict of law provisions.
If you are a consumer, you benefit from any mandatory provisions of the law of the country in which you reside, and nothing in these Terms affects your right to bring proceedings in your local courts where applicable law gives you that right.
Before bringing any formal proceeding, you agree to contact us at support@nexatlaslabs.com and attempt in good faith to resolve the dispute informally.
We may update these Terms from time to time, including as we ship updates beyond the App's first release. When we do, we will revise the "Last updated" date at the top of this page. Where changes are material, we will provide reasonable notice through the App or by other appropriate means before they take effect.
Your continued use of the App after revised Terms take effect constitutes acceptance of them. If you do not agree to the revised Terms, you must stop using the App and cancel any subscription.
